NO PURCHASE NECESSARY TO ENTER OR WIN
1. Eligibility: The Angels & Demons Path of Illumination Contest (the “Contest”)
is open only to legal residents of the fifty (50) United States (including D.C.),
Canada, France, Germany, Italy, Spain and the United Kingdom, who have reached the
age of majority in their state, country, province, region or other area of residence
and did not purchase any products, software, services or equipment for the purposes
of entering this Contest. Flash 9.0, a Windows Live ID and the Photosynth Web browser
plug-in application (for viewing and creating synths) are required to participate
in the Contest, but they may be obtained for free. To get a Windows Live ID, visit
http://get.live.com/. To download a free version of Photosynth, visit
http://www.photosynth.net.
Local system settings may prevent you from using Photosynth. You should ensure that
you have access to a system with the following minimum requirements:
•Operating System: Windows XP (SP2 or SP3) and
Windows Vista are supported;
•Web Browser: Internet Explorer 7, Firefox 2 and
Firefox 3;
•Memory: 256 MB minimum, and 1GB recommended;
and
•Graphics: A minimum 32MB of graphics memory required,
64MB or more is recommended. Photosynth runs on some DirectX6 capable cards and
all DirectX7 cards.
Employees of Microsoft Corporation (“Sponsor”), Columbia Tristar Marketing Group,
Inc., ePrize, LLC, Sony Electronics, Inc., Sony Pictures Home Entertainment, The
Piaggio Group, (Piaggio & C. S.p.A.) (“Piaggio”), and all other prize suppliers
associated with the Contest, any advertising and promotion agencies of any of the
above, and any other entity providing services or goods to any of the above in connection
with the Contest, and the affiliates of all of the foregoing (collectively, the
“Contest Entities”), as well as the immediate family (spouse, parents, siblings
and children) and household members of each such employee are not eligible. The
Contest is subject to all applicable national, federal, state, provincial and local
laws, regulations and directives. Void outside of the fifty (50) United States and
D.C., Canada, France, Germany, Italy, Spain, the United Kingdom and where prohibited.

3. Agreement to Official Rules: Participation in the Contest constitutes
your full and unconditional agreement to these Official Rules and to Sponsor's and
Administrator’s decisions, which are final and binding in all matters related to
this Contest. Winning a prize is contingent upon fulfilling all requirements set
forth herein.
4. Timing: The Contest begins on January 30, 2009 at 10:00 a.m. Pacific Time
("PT"), ends on March 27, 2009 at 9:59 a.m. PT (the "Contest Period") and consists
of two (2) rounds, and a tie-breaker round if necessary, as set forth in the chart
below.

5. How to Enter: You must enter the Contest during
the Round 1 (see the chart in Section 4 for specific dates). To enter the Contest,
visit
http://angelsanddemons.msn.com (the "Contest Site") and follow the
links and instructions to get a free Windows Live ID password (if you don’t already
have one) and register for the Contest. Complete the registration, including your
first and last name; a valid email address; your home mailing address, including
your street number (P.O. Boxes are not permitted), city, state/province, zip/postal
code and country; a phone number where you can be reached on or around March 28,
2009; your gender, date of birth, and Windows Live ID password.
(a) Round 1: After submitting the registration, you will be directed to an
online, flash-based puzzle. One (1) new, unique puzzle will be made available each
week; an earth puzzle ("Puzzle 1"), an air puzzle ("Puzzle 2"), a fire puzzle ("Puzzle
3") and a water puzzle ("Puzzle 4"). In this Round, each puzzle will consist of
three (3) levels of play and one (1) Photosynth clue. Follow the instructions to
complete all levels of play for each puzzle, using the fewest number of moves possible,
and finally unlock the Photosynth clue. You will receive a score after completing
each level of play. For both Round 1 and Round 2 (described below) and the Tie-Breaker
Round (described below), the scores for each level of play will be computed according
to the following formulas (the "Scoring Criteria"):
•Puzzle 1 score = (number of rotations) + (number of jumps)
+ (distance (per grid unit) the sphere traveled) + (number of deaths x 10)
•Puzzle 2 score = (distance (per pixel) the sphere
traveled) + (number of ‘air’ tiles used x100);
•Puzzle 3 score = (total number of pegs placed)
+ (number of rounds needed to complete x10); and
•Puzzle 4 score = (total number of moves) + (number
of deaths x10).
You may play each level as many times as you like until you believe that you have
achieved your best score. Once achieved, follow the instructions to submit your
score. You may only submit your most recent score. In other words, if you do not
improve your score with subsequent plays, then you cannot submit scores from earlier
plays. The last score you achieve is your final score and will be used to determine
whether you are a potential prize winner. You must complete all levels of all four
(4) puzzles and unlock all four (4) Photosynth clues by the required deadline in
order to advance to Round 2.
(b) Round 2: Round 2 will also consist of Puzzle 1, Puzzle 2, Puzzle 3 and
Puzzle 4. However in this Round, all four puzzles will be available at the start
of the Round. Each puzzle will have only one (1) level of play and you will have
only one (1) chance to complete each puzzle. The first score you receive on each
puzzle will be your final score and it will be automatically submitted. Follow the
instructions to solve all four (4) puzzles using the fewest number of moves as possible.
Your score will be determined based on the Scoring Criteria described in Section
5(a) above. You must complete all four (4) puzzles in Round 2 by the required deadline
to record a score.
6. Grand Prize Winner and Country Winner Determination: All winners will
be selected on the basis of skill, and chance will play no part in determining a
score. If you are the Grand Prize Winner, you will also be the Country Winner for
your particular country of residence.
(a) Grand Prize Determination: The potential Grand Prize winner will be the
eligible entrant who receives the lowest combined score from Round 1 and Round 2,
regardless of which country the entrant is from. Awarding the Grand Prize to the
potential Grand Prize winner is subject to the requirements set forth in Section
8, below. In the event that two (2) or more entrants are tied after Round 2, then
the entrant who received the lowest score on Round 2 Puzzle 3 will be deemed the
potential Grand Prize winner. In the event a tie still remains, further ties will
be broken as set forth in the “Breaking Ties” section below.
(b) Country Winner Determination: Winners will also be announced for each
eligible country. The entrant from each country who receives the lowest combined
score from Round 1 and Round 2, when compared to all other eligible scores submitted
by entrants residing in the same country, will be the potential Country Winner for
his/her respective country. The Grand Prize Winner will also be the Country Winner
for his/her country. Awarding any Country Winner prize is subject to the requirements
set forth in Section 8, below and the following tie breaker criteria (if applicable).
(c) Breaking Ties: In the event that two (2) or more entrants are tied for
awarding of any prize after Round 2, then the entrant who received the lowest score
on Round 2 Puzzle 3 (as described above in section 5(b) will be deemed the potential
prize winner. In the event a tie still remains, further ties will be broken by comparing
the scores each tied entrant received during each of the following puzzles, until
the tie is broken: Round 1 Puzzle 3, level 3; Round 1 Puzzle 3, level 2; Round 1
Puzzle 3, level 1; Round 2 Puzzle 2; Round 1 Puzzle 2, level 3; Round 1 Puzzle 2,
level 2; Round 1 Puzzle 2, level 1; Round 2 Puzzle 1; Round 1 Puzzle 1, level 3;
Round 1 Puzzle 1, level 2; Round 1 Puzzle 1, level 1; Round 2 Puzzle 4; Round 1
Puzzle 4, level 3; Round 1 Puzzle 4, level 2; and Round 1 Puzzle 4 level 1.
(d) Tie Breaker Round: In the event a tie still remains, all tied entrants
will be instructed to play a Tie-Breaker Round. The Tie-Breaker Round will consist
of the same four (4) puzzles as previous Rounds. All puzzles in this Tie-Breaker
Round will be available at the same time. Each puzzle will have one (1) level of
play and each tied entrant will be given only one (1) chance to play each puzzle.
The Tie-Breaker Round will be scored using the same Scoring Criteria as set forth
in Section 5(a), and any remaining ties will be broken as set forth in the “Breaking
Ties” section above.
For all entrants: In the event of a dispute as to any entry, the authorized
account holder, at time of entry, of the Windows Live ID used to register for the
Contest will be deemed to be the entrant and must comply with these Official Rules.
The “authorized account holder of the Windows Live ID” is the natural person assigned
a Windows Live ID address by Microsoft. The entrant may be required to show proof
of being the authorized account holder. Multiple entrants are not permitted to share
the same email address or Windows Live ID. Any attempt by any entrant to submit
more than the stated number of entries by using multiple/different email addresses,
Windows Live ID numbers, identities or any other method will void that entrant's
entries/plays and he/she will be disqualified from further participation in the
Contest. Use of script, macro or any other automated system to play is prohibited
and all such plays will be void. Personal data collected from this Contest will
be stored by the Sponsor on a server in the United States of America and entering
this Contest constitutes your consent to the export of your personal data to the
United States and its use there for the purposes of this Contest and associated
processing (e.g., back-up, archiving).
7. Prizes:
(a) ONE (1) GRAND PRIZE: A 2009 Lancia Delta automobile (if winner
is from France, Germany, Italy, Spain or the United Kingdom) or two (2) Aprillia
RSV 1000 R Motorbikes (if winner is from Canada or the United States); a Sony electronics
prize package consisting of a 55” Class Bravia XBR LCD Flat Panel HDTV, a 5.1 Channel
Blu-ray Disc Player Home Entertainment Theater System, a S-Air Wireless Surround
Sound Speaker Kit, a Bravia Wireless Link Module, a Blu-ray Disc Recordable/Rewritable
Drive, a Vaio TP Home Theater PC, a Digital Single Lens Reflex Camera Body and an
SAL-2470Z 24-70mm f2.8 Zoom Lens; and a piece of gold jewelry (a rosary cross and
matching necklace) designed by Damiani (size, karat and design to be determined
by prize provider in its sole discretion). For Lancia Delta: The applicable
prize provider will determine all features including but not limited to color of
exterior and interior, and all other features or upgrades will be allowed only if
permitted by delivery dealer and paid for by winner. Winner must be a licensed driver
or motor vehicle operator in his/her jurisdiction of residence and will be required
to provide proof of insurance (if applicable) at time of delivery. Winner is responsible
for title, license, registration, dealer preparation costs, insurance and other
fees associated with prize component. Winner must take delivery of prize from a
location in Rome, Italy or in the winner’s city of residence, as designated by Sponsor
or the applicable prize provider. For Aprillia RSV 1000 R Motorbikes: The
Grand Prize winner (if winner is from Canada or the United States, hereinafter the
"Winner") will be responsible for any additional costs associated with the motorbike,
including without limitation title, tax, license, PDI (pre-destination inspection),
registration, shipping, insurance, and any additional accessories and options as
agreed to between winner and the authorized Aprilia USA or Canada dealership location
at which the motorbikes will be delivered, as determined by Piaggio in its sole
discretion. Such Winner will be responsible for pick-up of the motorbikes at a time
and location determined in the sole discretion of Piaggio (Piaggio will endeavor,
as a courtesy, to select a dealership close to the residence of the applicable winner).
The Winner (or his/her parent/legal guardian, if applicable) are also responsible
for shipping organization and shipping charges from the authorized Aprilia USA or
Canada dealership where pick up is scheduled to any other location if winner is
unable or unwilling to accept delivery at such dealership. Winner must complete
all documentation required by Sponsor, Piaggio and/or Administrator. At time of
award of the motorbikes, the Winner (i) will assume full ownership of and responsibility
for the motorbike; (ii) will be required to sign various documents involving the
motorbikes; and (iii) must furnish proof of residence, valid operator’s license
as required by the law of the Winner’s jurisdiction of residence and of the jurisdiction
of pickup and any required insurance coverage. The Winner is responsible for determining
the class of license necessary to legally operate the motorbikes. Piaggio reserves
the right to withhold delivery of the motorbikes if the Winner does not comply with
the above requirements. The Winner is solely responsible for complying with any
applicable federal, state and/or local laws and regulations applicable to the motorbikes,
including without limitation registration requirements and operating restrictions.
If selected, when the Winner does not take delivery of the motorbikes by August 1,
2009, this prize component may be forfeited, at Sponsor’s sole discretion.
Sponsor, Piaggio and/or Administrator are not responsible for delays in delivery.
All other expenses and items not specifically mentioned in these Official Rules
are not included and are the Winner’s sole responsibility. Neither Sponsor, Piaggio
nor Administrator have made any warranty or guarantee in whole or in part, express
or implied, in fact or in law, in relation to the use of any prize including, but
not limited to, its quality, merchantability, fitness for a particular purpose or
suitability for use and, further, accepts no responsibility for any additional expenses,
omissions, delays, re-routing or acts of any government or authority. For Electronic
Prizes: The ARV of electronic prizes is subject to price fluctuations in
the consumer marketplace based on, among other things, any gap in time between the
date the ARV is estimated for purposes of these Official Rules and the date the
prize is awarded or redeemed. For All Prize Components: ARV: $54,438 USD
(approximately 43,252.68 Euros; live rates at 2008.12.01 20:16:44 UTC).
(b) SEVEN (7) COUNTRY WINNER PRIZES (ONE (1) WINNER PER COUNTRY):
A trip for the each country winner and one (1) travel companion per winner to Rome,
Italy for the premiere of the Angels & Demons movie; a Vespa S 125 or Vespa S 150
(“Vespa”) (model provided will be associated with winners country); and a piece
of jewelry (a camerlengo cross and matching chain necklace) designed by Damiani
(size, karat and design to be determined by prize provider in its sole discretion).
For Trip Package: Trip package includes roundtrip, coach-class air transportation
for two (2) from a major gateway airport near winner’s home (determined by Sponsor
in its sole discretion) to Rome, Italy; five (5) nights (if winner is from Canada
or the United States) or three (3) nights (if winner is from France, Germany, Italy,
Spain or the United Kingdom) standard accommodations at a hotel of Sponsor's choice
(single room, double occupancy); two (2) tickets for the Path of Illumination tour
in Rome, Italy (length and content of tour selected by Sponsor in its sole discretion);
and two (2) tickets to the Angels & Demons premiere and after party. For Travel Prizes:
Each country winner and his/her travel companion must travel on the exact dates
specified by Sponsor in its sole discretion, or prize will be forfeited. Travel
dates will occur in April or May, 2009. No refund or compensation will be made in
the event of the cancellation or delay of any flight or other mode of transportation.
All expenses and costs not listed in the prize descriptions above, including without
limitation, spending money in excess of the amount provided, additional meals, transfers,
transportation to and from departure point, hotel services and amenities, (including,
but not limited to, additional room charges such as pay per view movies, laundry,
room service, telephone calls), souvenirs, gratuities, flight or travel insurance,
taxes, any upgrades or additional nights and all other ancillary costs are not included
and are the sole responsibility of each of the prize winners and the prize winner’s
travel companion. Insurance not included but each country winner and his/her travel
companion may obtain insurance covering travel-related risks. The country winner
and his/her travel companion must depart from and return to a point of departure
located in the same country. Country winner and travel companion must travel on
the same itinerary. Frequent flyer points (if any) will not constitute part of the
prize. Each prize component is subject to the standard terms and conditions of the
prize provider that supplied it. Each country winner may be required to present
credit card at time of accommodation check-in. If for any reason whatsoever a country
winner does not, once the prize has been booked, take the prize or an element of
the prize at the time stipulated, then the prize or that element of the prize will
be forfeited by the prize winner and money will not be awarded in lieu of the prize
or that element of the prize. None of the Contest Entities are responsible if the
Angels & Demons premiere and/or after party are delayed, cancelled or postponed,
in which event that portion of the prize will be forfeited and no substitution offered.
Sponsor will determine travel arrangements in its sole discretion. Each country
winner will receive his/her travel itinerary by mail or email within seven (7) days
prior to travel. Actual value of travel may vary based on airfare fluctuations and
distance between departure and destination. Country winner will not receive difference
between actual and approximate retail value. For Vespa: Each Country Winner
will be responsible for any additional costs associated with the Vespa, including
without limitation title, tax, license, PDI (pre-destination inspection), registration,
shipping, insurance, and any additional accessories and options as agreed to between
winner and the authorized Vespa USA/Europe/Canada dealership location at which the
Vespa will be delivered. The dealership to which the Vespa will be delivered will
be determined by Piaggio in its sole discretion. Each Country Winner will be responsible
for pick-up of the Vespa at a time and location determined in the sole discretion
of Piaggio (Piaggio will endeavor, as a courtesy, to select a dealership close to
the residence of the Country Winner). Each Country Winner (or his/her parent/legal
guardian, if applicable) are also responsible for shipping organization and shipping
charges from the authorized Vespa dealership where pick up is scheduled to any other
location if Country Winner is unable or unwilling to accept delivery at such dealership.
Country Winner must complete all documentation required by Sponsor and/or Administrator.
At time of award of Vespa, each Country Winner (1) will assume full ownership of
and responsibility for the Vespa; (2) will be required to sign various documents
involving the Vespa; and (3) must furnish proof of residence, valid operator’s license
as required by the law of the Country Winner’s jurisdiction of residence and of
the jurisdiction of pickup and any required insurance coverage. Each Country Winner
is responsible for determining the class of license necessary to legally operate
the Country Winner. Piaggio reserves the right to withhold delivery of the Vespa
if Country Winner does not comply with the above requirements. Each Country Winner
is solely responsible for complying with any applicable federal, state and/or local
laws and regulations applicable to the Vespa, including without limitation registration
requirements and operating restrictions. If selected, when Country Winner does not
take delivery of Vespa by August 1, 2009, the Country Winner Prize may be
forfeited, at Sponsor’s sole discretion. Sponsor and Administrator are not responsible
for delays in delivery. All other expenses and items not specifically mentioned
in these Official Rules are not included and are the Country Winner’s sole responsibility.
For Full Prize Package: ARV: $16,287 USD (approximately 12,2630.87 Euros;
live rates at 2008.12.08 15:09:12 UTC). There is no monetary value attached to the
Angels & Demons premiere and after party.
For All Prizes: Prizes are non-transferable and no substitution or cash redemption
will be permitted unless Sponsor, in its sole discretion, determines otherwise.
Sponsor reserves the right to substitute a prize (or portion thereof) with one of
comparable or greater value, at its sole discretion.
Except for residents of Italy,
winners of any prize are responsible for all federal, state and local taxes and
any other costs, expenses or fees associated with prize acceptance and/or use not
specified herein as being provided. The Canadian Country Winner and the
Grand Prize winner (if a legal resident of Canada) will be required to return to
Administrator an IRS W8-BEN form at the end of the taxable year the prize was awarded.
This form is required by the United States tax authorities to establish exemptions
to tax in the United States for claiming a prize. The value of each prize as set
forth above represents Sponsor’s, its prize providers and Administrator's good faith
determination of the ARV thereof and cannot be challenged or appealed. In the event
the ARV of a prize is more than the actual retail value of the prize, the difference
will not be awarded in cash or otherwise.
For Prizes Won by Italian Residents: If after three (3) attempts a potential
winner cannot be verified for any individual prize, then that prize will be donated
to the Organizzazioni non lucrative di utilità sociale (“ONLUS”), as required by
Italian law. Sponsor reserves the right to donate the monetary value of the prize
(at the time of determining winners) instead of the actual prizes if the prize must
be donated to the ONLUS.
8. Prize Winner and Travel Companion Requirements: Each potential prize winner
will be notified by mail, email or phone on or around March 28, 2009. The potential
Grand Prize winner will be notified in person and via email, mail or phone on or
around the date of the Angels & Demons premiere mentioned in Section 7(b) above
(subject to the Contest Entities' sole discretion).
For residents of the United States
(including D.C.) : Each potential prize winner, regardless of prize, will
be required to execute and return to Administrator, within three (3) days of the
date notice or attempted notice is sent, an Affidavit of Eligibility, Liability
& Publicity Release (“Affidavit”) in order to claim his/her prize.
For residents
of Canada: Each potential prize winner, regardless of prize, will be required
to execute and return to Administrator, within three (3) days of the date notice
or attempted notice is sent, a Declaration of Compliance (“Declaration”) in order
to claim his/her prize.
For residents of France: When a French winner or
travel companion receives a document called “eligibility/publicity release” destined
to obtain his/her free consent to use his/her full name, likeness, city of residence
and photographs for promotional purposes and without additional compensation, his/her
lack of consent does not prevent the winner from receiving the prize.
For travel
companions: Each travel companion must complete, sign and return a Publicity/Liability
Release (where legal) and any other requested paperwork to Administrator in order
for travel documents or tickets to be awarded.
For all potential prize winners and
travel companions: Unless a resident of Italy, each potential prize winner
and his/her travel companion will also be required to obtain and provide proof of
documents required for international travel.
For all potential prize winners:
If a potential winner of any prize cannot be contacted, fails to execute and return
any documents required by Administrator within the required time period (if applicable),
is not in compliance with these Official Rules, or prize or prize notification is
returned as undeliverable, he/she forfeits the prize. If a potential winner is disqualified
or forfeits the prize for any reason, the applicable prize will be awarded to a
runner-up, if any, at Sponsor’s discretion. Only three (3) alternate winners may
be selected through this process, after which the applicable prize will remain un-awarded.
Acceptance of any prize shall constitute and signify winner’s agreement and consent
that each of the Contest Entities may use the winner’s, name, city, state, likeness,
photo and/or prize information in connection with the Contest for promotional, advertising
or other purposes, worldwide, in any and all media now known or hereafter devised,
including the Internet, without limitation and without further payment, notification,
permission or other consideration, except where prohibited by law.
9. Release: Except for entrants who are residents of France, Germany, Spain, and/or
the United Kingdom, with respect to claims resulting from death or personal injury
only (in accordance with applicable law in those jurisdictions), by participating
in the Contest (or any part thereof), each entrant agrees to release and hold harmless
each of the Contest Entities and each of their respective officers, directors, employees,
shareholders, and agents (collectively, the “Released Parties”) from and against
any claim or cause of action arising out of participation or inability to participate
in the Contest or receipt or use, misuse or inability to use any prize.
10. General Conditions: Sponsor reserves the right to cancel, suspend and/or
modify the Contest, or any part of it, if any fraud, technical failures or any other
factor impairs the integrity or proper functioning of the Contest, as determined
by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion,
determine the prize winners from among all non-suspect, eligible entries received
up to time of such action using the Scoring Criteria outlined above. Sponsor, in
its sole discretion (subject to the approval of the Régie des Alcools, des Courses
et des Jeux in the Province of Quebec), reserves the right to disqualify any individual
it finds to be tampering with the entry process or the operation of the Contest
or to be acting in violation of these Official Rules or in an unsportsmanlike or
disruptive manner and void all associated entries. Any attempt by any person to
deliberately undermine the legitimate operation of the Contest may be a violation
of criminal and civil law, and, should such an attempt be made, Sponsor reserves
the right to seek damages and other remedies (including attorneys’ fees) from any
such person to the fullest extent permitted by law. Any of the Contest Entities’
failure to enforce any term of these Official Rules shall not constitute a waiver
of that provision.
11. Releases of Liability; Limitations of Liability: Each entrant hereby
agrees to release, indemnify and hold harmless each of the Released Parties from
any claim, action, proceeding, cause of action, damage, loss, liability, costs and
expenses, including, without limitation, reasonable outside attorney’s fees and
costs arising from or in connection with: (1) any incorrect or inaccurate information,
whether caused by entrant, printing, typographical or other errors or by any of
the equipment or programming associated with or utilized in the Contest; (2) technical
failures of any kind, including, but not limited to malfunctions, interruptions,
or disconnections in phone lines or network hardware or software; (3) unauthorized
human intervention in any part of the entry process, puzzle game play process, tie
breaker application, or Contest participation; (4) printing, typographical, technical,
computer, network or human error which may occur in the administration of the Contest
(including but not limited to the administration/functionality/scoring of the puzzles),
the uploading or processing of entrant registrations, the scoring methodology, the
awarding of scores, the application of scoring or tie-breaking criteria, the announcement
of the prizes, prize winners, Grand Prize winner or in any Contest-related advertising,
promotional or administrative materials; (5) late, lost, undeliverable, damaged
or stolen mail or communications; or (6) any injury or damage to persons or property
which may be caused, directly or indirectly, in whole or in part, from entrant’s
participation in the Contest and/or receipt or use or misuse of any prize (including
any travel or any activity related thereto), except where prohibited by law. Released
Parties are not responsible for misdirected or undeliverable entries or for any
technical problems, malfunctions of computer systems, servers, providers, hardware/software,
lost or unavailable network connections or failed, incomplete, garbled or delayed
computer transmission or any combination thereof. Released Parties are not responsible
for any unauthorized third party use of any Submission, except if directly attributable
to the gross negligence of the Released Parties.
12. Disputes: Except where prohibited, entrant agrees that: (1) any and all
disputes, claims and causes of action arising out of or connected with this Contest
or any prize awarded shall be resolved individually, without resort to any form
of class action, and exclusively by the United States District Court for the Eastern
District of Michigan (Southern Division) or the appropriate Michigan State Court
located in Oakland County, Michigan; (2) any and all claims, judgments and awards
shall be limited to actual out-of-pocket costs incurred, including costs associated
with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances
will entrant be permitted to obtain awards for, and entrant hereby waives all rights
to claim, indirect, punitive, incidental and consequential damages and any other
damages, other than for actual out-of-pocket expenses, and any and all rights to
have damages multiplied or otherwise increased. All issues and questions concerning
the construction, validity, interpretation and enforceability of these Official
Rules, or the rights and obligations of the entrants and Sponsor in connection with
the Contest, shall be governed by, and construed in accordance with, the laws of
the State of Michigan without giving effect to any choice of law or conflict of
law rules (whether of the State of Michigan or any other jurisdiction), which would
cause the application of the laws of any jurisdiction other than the State of Michigan.
For Residents of Quebec Only: Any litigation respecting the conduct or organization
of a publicity contest may be submitted to the Régie des Alcools, des Courses et
des Jeux for a ruling. Any litigation respecting the awarding of a prize may be
submitted to the Régie only for the purpose of helping the parties reach a settlement.
13. Entrants’ Personal Information: Information collected from entrants is
subject to Sponsor’s Privacy Policy (

Information will only be collected by Sponsor on the Contest Site. Entrants who
opt-in to receive additional information from other Contest Entities will have their
information shared with those other Contest Entities and such personally identifiable
information is subject to each Contest Entities' Privacy Policy.
All information submitted to the Sponsor as part of this Contest will be treated
in accordance with the Sponsor’s privacy policy, available at

Sponsor and Administrator have notified the US Department of Commerce that they
adhere by the rules of the Safe Harbor Framework available under

Personal information includes name, address, email address, birthday and phone number,
and will be used to: (a) contact potential winners; and (b) if an entrant selects
to receive additional information from the Sponsor on the entry form, to send additional
information to that entrant. The recipients of your personal data are the Sponsor
and Administrator. YOUR INFORMATION WILL NOT BE STORED OR PROCESSED ON SERVERS LOCATED
IN THE EUROPEAN UNION.
14. Winners’ List: Winners' List requests will only be accepted after the
Contest end date (listed above) and no later than July 28, 2009. For the Winners'
List, send an email with subject line: "The Angels & Demons Path of Illumination

15. General: Nothing in these Official Rules shall be deemed to exclude or
restrict any of the winner's or the entrant's statutory rights as a consumer.
16. For Residents of France Only: These Official Rules have been filed with

Paris. Pursuant to French law pertaining to data collection and processing, you
have a right of access to, modification and withdrawal of your personal data. You

to disabling and deletion of your data and, in certain circumstances, the right
